Les députés réunis ce jeudi 09 mai en session plénière ont voté à la majorité écrasante des présents contre la polygamie en Guinée. 69 voix contre deux des 71 députés présents ont donné une suite favorable à cette nouvelle loi.
Ainsi à l’article 281 du chapitre VI relatif à l’option des époux entre la monogamie et la polygamie, le mariage est désormais soumis au régime de la monogamie pour tous les citoyens guinéens.
Toutefois, précise la loi, le futur mari peut, au moment de la célébration du mariage, en présence de sa future épouse et avec l’accord explicite de celle-ci, déclarer qu’il opte pour la polygamie limitée à deux (2), trois (3) ou quatre (4) femmes qu’il ne peut dépasser. Faute par l’homme de souscrire à l’une des options de la polygamie, le mariage est placé de manière irrévocable sous le régime de la monogamie, sauf dispense accordée dans les conditions prévues à l’article 282 du présent code.
En l’absence d’accord entre les futurs époux sur l’option de la polygamie, l’officier de l’état civil ne peut célébrer le mariage
Quitte maintenant à savoir si cette nouvelle loi est applicable à ceux qui sont déjà mariés et qui n’avaient pas souscrits à ce principe. Le Chef de l’Etat va-t-il la promulguer? Tout porte-à-croire qu’il en fera après qu’il est ait refusé d’apposer sa signature après un premier vote favorable à la polygamie
