Les partis membres de l’Opposition politique dénoncent solennellement le chronogramme diffusé par la CENI qui viole la loi électorale et ignore la situation politique et sanitaire du pays pour fixer, sans concertation préalable avec les autres acteurs politiques, la date de l’élection présidentielle au 18 octobre 2020.
En effet, il est inadmissible que le président de la CENI, sans concertation préalable avec la classe politique, saisisse la Cour constitutionnelle d’une requête pour solliciter l’autorisation de supprimer purement et simplement les délais légaux fixés par le Code électoral.
Il est aussi scandaleux de constater que la Cour constitutionnelle autorise cette suppression sans base légale ni consensus politique comme si les dispositions de la loi organique fixant les différents délais étaient des dispositions supplétives auxquelles on peut déroger par une volonté contraire.
Une Cour constitutionnelle ne peut se substituer au législateur ou autoriser la violation de la loi, de surcroît une loi organique, sans un large consensus politique.
En outre, en supprimant les délais liés aux opérations d’affichage, de correction et de gestion des contentieux, la CENI et la Cour constitutionnelle violent le droit communautaire car le contrôle des listes électorales est essentiel aussi bien pour les électeurs que pour les acteurs politiques, surtout pour un fichier dont la crédibilité et la fiabilité sont unanimement contestées.
En effet, l’article 5 du Protocole de la CEDEAO dispose : « Les listes électorales seront établies de manière transparente et fiable avec la participation des partis politiques et des électeurs qui peuvent les consulter en tant que besoin ».
En agissant ainsi, le Président de la CENI et de la Cour constitutionnelle, qui ont violé à plusieurs reprises leurs serments et mis en évidence leur manque d’indépendance dans la préparation et l’organisation du double scrutin du 22 mars, récidivent dans la préparation de l’élection présidentielle de 2020.
Compte tenu de tout ce qui précède et compte tenu de la volonté de l’Opposition politique de participer à des élections apaisées, inclusives, libres et transparentes, elle rejette catégoriquement ce chronogramme illégal et exige :
1 – l’annulation du double scrutin du 22 mars par la dissolution de l’Assemblée Nationale et de la Constitution qui en sont issues ;
2- La libération et l’arrêt des poursuites contre les militants du FNDC détenus ou poursuivis pour leurs activités contre le troisième mandat ;
3 – L’installation des Conseils régionaux en même temps que les Conseils de quartier ou de district ;
4 – l’ouverture d’un dialogue politique, sous les auspices de la communauté internationale, pour identifier et mettre en œuvre toutes les actions permettant à la Guinée de disposer de:
- a) Un Fichier électoral sincère et consensuel ;
- b) Un chronogramme réaliste, légal et consensuel ;
- c) Un organe de gestion des élections compétent, neutre et impartial ;
- d) Une juridiction en charge du contentieux électoral intègre et indépendante.
